Terms and Conditions

1. Agreement to these terms

By booking a session, buying a membership, purchasing an add on service, or using our space, you agree to these terms. If you are booking for a company or on someone else’s behalf, you confirm you have authority to accept these terms for them, and you are personally responsible for the booking.

2. Bookings and payment

All bookings are made through our online calendar and are confirmed only when you receive a confirmation email from us. Drop in sessions are paid in full at the time of booking. Add on services are prepaid. We may require a card on file for any booking. Prices are listed on our site, are in US dollars, exclude any applicable tax, and may change at any time, though the price you were charged for a confirmed booking will not change

3. Memberships

Memberships bill every 4 weeks and renew automatically until canceled. Membership terms, including billing, included hours, holds, and the 30 day cancellation notice, are set out in our Studio Membership Agreement, which you accept at checkout and which controls if it ever conflicts with this page.

4. Cancellations, reschedules, and no shows

Cancel or reschedule at least 24 hours before your start time and we will move your booking or return your hours. Inside 24 hours, members forfeit the hours and drop in customers are charged 50 percent of the session. If you do not show up, the full session is charged and any prepaid add ons are not refunded. Arriving late does not extend your session, and sessions run over in 15 minute increments charged at the applicable hourly rate.

5. If we have to cancel

If we cancel or cut short a session because of equipment failure, a power or internet outage, weather, a facility issue, or anything else outside our control, we will reschedule it or credit the time back to you. That reschedule or credit is our full responsibility to you, and we are not liable for anything else arising from a canceled session.

6. Studio rules

Everyone in the building agrees to follow our posted rules: no smoking or vaping, lidded drinks only in the recording booth, no food at the desk, no changes to our equipment setup or settings, guest limits and room capacity respected, and the space left clean and reset. Access codes are personal and may not be shared. We may charge a reset fee for a space left unusable for the next booking, and we may end a session immediately for behavior that endangers people or property.

7. Equipment and damage

Our equipment is provided as is and stays our property. You are responsible for the repair or replacement cost of anything you or your guests damage beyond normal use, and you authorize us to charge your card on file for it. Bringing your own equipment is fine with our prior approval, and we are not responsible for your gear or for anything you leave behind. Items left behind are held for 30 days.

8. Guests and minors

You are responsible for everyone you bring. All guests must sign our release before entering the studio areas. Anyone under 18 must be accompanied by a parent or guardian for the whole session, with a signed release from that parent or guardian.

9. Your recordings and your rights

You own the recordings and content you create in our space. You are responsible for obtaining consent from everyone who appears in or contributes to them, and for holding the rights to any music, footage, or other material you use. We are not a party to your content and we do not review, approve, or archive it. Unless we agree otherwise in writing, we do not retain copies of your files, and you are responsible for taking your files with you or transferring them before you leave.

10. Our marketing use of the space

We may photograph and film our own space, including sessions in progress and recognizable images of the people in them, and use those images to market the studio. If you would rather not be included, tell us in writing before or during your session and we will exclude you.

11. What you may not do here

You may not use our space to produce anything unlawful, to harass or threaten anyone, to infringe someone else’s rights, to record someone without their consent where consent is required, or for any commercial activity we have not agreed to, including reselling or subletting studio time. We may refuse or end any booking on these grounds.

12. Liability

You use the studio at your own risk and you accept the ordinary risks of a working production space. To the fullest extent the law allows, Linton Peak Performance, LLC and its owners, employees, and contractors are not liable for injury, illness, property loss or damage, lost recordings, lost revenue, or lost opportunities arising from your use of the studio, except where caused by our gross negligence or willful misconduct. Our total liability for any claim is limited to the amount you paid us for the booking or, for members, the membership fees paid in the 3 months before the claim. You agree to indemnify us against claims brought by your guests or collaborators arising out of your session.

13. Emails and texts

When you book or buy from us, we will send you the emails you need for that booking, including confirmations, reminders, receipts, and account notices, and you cannot opt out of those while you have an active booking or membership. If you opt in to marketing emails or text messages you can unsubscribe at any time, and you can stop texts by replying STOP. Message and data rates may apply. Our Privacy Policy explains what we collect and how we use it.

14. Photography and content space bookings

Content space bookings are for photography and content creation during the booked time only. Sets and props provided by us may be used but not removed or altered. Extra time for setup and teardown is part of your booked time, so book accordingly.

15. Changes to these terms

We may update these terms at any time by posting a new version here. If a change materially affects an active membership, we will email members at least 30 days in advance. Bookings already confirmed are governed by the terms in effect when they were confirmed.

16. Governing law and disputes

These terms are governed by the laws of the State of Georgia. Any dispute will be brought in the state or federal courts serving Cherokee County, Georgia. Before filing anything, please contact us at [email protected] so we can try to sort it out directly, which usually works.
