Studio Membership Agreement

1. What you are buying

A recurring membership to Woodstock Podcast Studios at the plan and price shown at checkout, which includes the studio hours listed for that plan for each 4 week billing cycle, plus member rates on additional hours and add on services. Your membership begins the day you complete checkout.

2. Billing every 4 weeks, and automatic renewal

Your membership bills every 4 weeks and renews automatically. Your first billing date is the day you complete checkout, and every billing date after that falls 28 days later, so your billing date moves through the calendar rather than landing on the same date each month. You authorize us to charge your payment method on file the plan price, plus any overage hours, add on services, guest fees, or damage charges, on each billing date until you cancel. Prepaid 12 week and 52 week terms bill once up front and then continue on the standard 4 week cycle at the then current rate unless you renew or cancel. All prices are in US dollars and exclude any applicable tax.

3. Included hours

Your included hours reset on each billing date, so every 4 weeks, and do not roll over. Unused hours expire at the end of each billing cycle and are not refunded or credited. Hours cannot be sold, shared, or transferred to anyone else.

4. Cancellation, 30 Days Notice

You may cancel your membership at any time by providing 30 days’ written notice by email to [email protected]. Notice received 30 or more days before your next billing date will end your membership at the end of your current billing cycle, with no further charge. Notice received fewer than 30 days before your next billing date will process one final payment, and your membership will end at the end of that billing cycle.

You will retain full access to the studio until your membership ends. We do not provide refunds or prorate partial billing cycles, unused hours, or prepaid terms. We will email you a confirmation of your cancellation with your exact membership end date, and that confirmation will serve as your record of cancellation.

5. Price changes

We may change membership prices with at least 30 days notice by email to the address on your account, which is always more than one full billing cycle. If you are inside a prepaid term, your rate is locked until that term ends. Continuing your membership after the notice period means you accept the new price.

6. Late or failed payments

If a payment fails we will retry it on days 1, 3 and 7. Your booking access will be suspended on day 8, and your membership will be terminated on day 15 with the unpaid balance still due. A late fee of [$X] may be added after day 7. You are responsible for keeping a valid payment method on file.

7. Booking, late cancellations, and no shows

Sessions are booked through our online calendar, subject to availability and to the booking rules published on our site. Cancel or reschedule at least 24 hours before your start time and the hours return to your balance. Inside 24 hours, the hours are used. If you do not show, the hours are used and any add on services booked for that session are still charged. Sessions run in 15 minute overtime increments at your plan’s overage rate, and arriving late does not extend your session.

8. Card on file, damage, and extra charges

You agree to keep a valid payment method on file for the duration of your membership and you authorize us to charge it for overage hours, add ons, guest fees, late fees, reset fees, and the repair or replacement cost of studio property that you or your guests damage beyond normal use. We will tell you before charging anything outside your normal plan price whenever we reasonably can.

9. Studio rules

You and your guests agree to follow the studio rules posted on our site and in the space, including the no smoking policy, the equipment handling rules, guest limits, and access rules. Door codes and access credentials are personal to you and may not be shared. You may not sublet, resell, or transfer your membership, hours, or access.

10. Your content, our marketing

You own everything you record and create here. We claim no rights to it. You are responsible for having permission from everyone who appears in or contributes to your recordings, and for the rights to any music or other material you use. Separately, we may photograph or film the space during your session for our own marketing, including recognizable images of you and your guests, unless you tell us in writing that you would rather we did not. Just ask and we will stop.

11. Your risk, and release

Using a studio means cables, lighting, stands, mounted equipment, and moving around a working space. You accept the ordinary risks of being here and you agree that you are responsible for your own safety and your guests’ safety. You release Linton Peak Performance, LLC and its owners, staff, and contractors from claims for injury, illness, or loss of or damage to your property arising from your use of the studio, except where caused by our gross negligence or willful misconduct. You agree to cover us for any claim brought by one of your guests or collaborators arising out of your session.

12. Limit of our liability

We do our best to keep the gear working and the doors open, but we cannot guarantee a recording will be usable, that equipment will not fail, or that we will never have to close for maintenance, weather, or a utility outage. If we cancel a session, we will reschedule it or credit the hours back, and that is your remedy. Our total liability to you for any claim is limited to the membership fees you paid us in the 3 months before the claim. We are not liable for lost recordings, lost revenue, or lost opportunities.

13. If we end your membership

We may suspend or terminate your membership immediately for non payment, for breaking the studio rules, for damaging property, or for behavior that puts our staff, our members, or the space at risk. If we terminate for cause, we do not refund the current period or any prepaid term. If we close the studio or discontinue your plan, we will refund the unused portion of any prepaid term.

14. Governing law

This agreement is governed by the laws of the State of Georgia, and any dispute will be brought in the state or federal courts serving Cherokee County, Georgia. If any part of this agreement is unenforceable, the rest still applies.

15. The whole agreement

This agreement, together with the Terms and Conditions and the booking rules published on our site, is the entire agreement between us and replaces anything said or written before it. We may update these terms with 30 days notice by email. By completing checkout you confirm that you have read and agree to all of it, that you understand your membership bills every 4 weeks until you cancel, and that you are at least 18 years old.
